PURPOSE

This agreement concerning the sale of products online is between the company Virgen and generally an individual end buyer as part of a distance selling system.

OFFER

The buyer must complete an order form for orders to be accepted and confirmed.
By completing the order form, the buyer confirms a commitment to purchase. Orders are confirmed by email with the name and references of Virgen. The confirmation email includes the product description, price including tax and the amount of shipping fees.

PRICES AND TAXES

Prices are denominated in euros. The prices indicated include all taxes and VAT for France and EEC countries but do not cover shipping fees. For online orders, the total price indicated in the order confirmation includes the price of the products and shipping fees.
You must inquire about any customs fees that may apply upon delivery of the merchandise. Any import taxes must also be paid by the end recipient upon arrival of the merchandise.

SHIPPING FEES

Shipping fees are not included in the retail price. To reduce shipping costs as much as possible, all products are shipped through a service offered by the French post office, Lettre Suivie for each purchases (illustrations, patches, etc.)
Orders are shipped within 7 days maximum, every Thursday :)
You can also pick up the products you ordered at a post office near the delivery address if you are absent the first time the postman tries to deliver. Essentially,
if you are absent the day of delivery, your postman will leave you a missed delivery notification in your mailbox.
You have 15 days to take this notification slip to the post office during opening hours and pick up your parcel. 

PAYMENT

Our website uses STRIPE or PAYPAL,
the most used and secured API for online payments. It can accepts all kinds of cards. Used by most of the e-commerce website, the cryptographic protocol technology
is the most secured of the market. The card number entered is only known by Stripe.
It does not go through the website server. The order confirmed by the customer
is only effective once the bank payment centres have authorized payment.
If payment is refused, the order is automatically cancelled and the customer is informed by email.  Ownership of the products passes to you once the price
of the merchandise has been paid in full.

DELIVERY

The products are sent to the delivery address indicated by the buyer during the order process. In the event of an error in the name or address, the seller shall not
be held liable if the product cannot be delivered. Shipping fees are expressed including tax. Any delays in delivery do not entitle the buyer to claim damages. Virgen shall not be held liable for any shipping delays due to the service
of La Poste. Returns for the reason "NFTA": These parcels are returned by the delivery service for the following reason: Not Found at This Address. Within 48 hours after we receive and accept your parcel, your account will be credited for the total order amount, minus shipping fees.
You can then order again. Returns for the reason "unclaimed": These parcels are not claimed at the post office within the proper time frame (15 days). Within 48 hours after we receive and accept your parcel,
you will have to pay again the delivery fees so that we send you back the parcel.

NON-CONFORMITY

If the good delivered is not the product ordered (based on the confirmation email), Virgen shall correct the mistake (including reshipping fees). For any claims, please contact us by email or by post within 10 days following delivery
of the parcel.

DAMAGE DURING SHIPMENT

You should not accept a parcel if the outside packaging has any trace of an impact. If your parcel is delivered directly to your mailbox or by your postman and
is unfortunately damaged, you must go to your post office and request a report for damaged shipment without opening it.
If you do not request the report the same day as your delivery, the post office will refuse to give it to you, and we will be unable to request compensation.
In this case, you must send us a letter or email of complaint within two days following the delivery date.

EXCHANGE

For exchanges, please send back the items (in perfect condition), over a period of 10 days after the Delivery of your order. Contact us by email for the details : virgen.design@gmail.com

PERSONAL INFORMATION

Virgen shall not disclose the information provided by buyers and visitors on the website to any third parties.
This information is confidential. By placing the order, the buyer agrees to the use of personal data collected under the terms of the current order for the customer file but can object by email or in writing. Under French Act No. 78-17 of 6 January 1978, the consumer has the right to access and correct any personal data.

CUSTOMER SERVICE

APPLICABLE LAW

This agreement is governed by French law and more specifically by distance selling regulations.

SETTLEMENT OF DISPUTES

Claims and disputes will always be examined carefully, as it is always assumed that
any person who takes the trouble to express these situations is acting in good faith. In the event of a dispute, the customer shall first contact the company to seek an amicable solution. This agreement is governed by French law. The original language of this agreement is French. Should a dispute arise, the agreement falls under the exclusive jurisdiction of the competent court of Paris, France. Virgen shall not be held liable
for any property or non-property damage or bodily injury that may result from the improper use of the products sold.

CONFIDENTIALITY CHARTER AND USE OF PERSONAL DATA

The information you provide on the website https://www.virgen-design.com is used by Virgen to process and fill your orders. In application of Article 32
of the French Data Protection Act of 6 January 1978, the information required
by Virgen to process and fill orders is marked with an asterisk on the web pages.

Under the French Data Protection Act, Virgen shall comply with French and European legislation on protecting personal data and guarantees the right to individual privacy and freedom.

Under French Act No. 78-17 of 6 January 1978, you have the right to oppose the use of personal data which can be exercised by sending a letter to the customer service
department of Virgen :
• by e-mail : virgen.design@gmail.com
• or by completing the electronic form available in the « contact us » section of the website.

Website users will be contacted by the website Virgen in the following cases :
• Creation of a customer account :
You receive a welcome email containing your user name and password.
• Request to close the account : If the account is closed,
an email is sent to notify the user that the account has been closed.
• Online purchase : You receive a confirmation email and invoice when you make a purchase online.
• Request for assistance or submission
of questions/suggestions : Virgen will answer you by email.

Our website also uses social media plugins including Facebook, Pinterest, Instagram, etc.

If you interact using these plugins, 
for example by clicking "Like" or "Share",
the browser information on our website and your social media membership
are sent to and stored on a company server connected to these social media.
The information is shared depending on your user account settings, under the terms of use of the social media website in question.

If you do not want a social media website to link the information collected through our website to your user account, you must log out of the social media website prior
to visiting our website. In any case, the use of these plugins and buttons is operated
by the social media and is governed exclusively by the terms that bind you and the social media of which you are a member.
